1. Acceptance of Terms

By using this website or engaging Truck Peak Dispatch LLC's services, you agree to these Terms of Service. If you do not agree, please do not use our website or services.

2. Who We Are

Truck Peak Dispatch LLC is an independent dispatch service. We are not a motor carrier and not a freight broker. We act as an authorized agent for the carriers we work with, within the scope of a signed carrier-dispatch agreement and limited authorization.

3. Eligibility

Our services are intended for U.S.-based owner-operators and small trucking companies. Where applicable, you must hold active operating authority (USDOT/MC) appropriate to your operations, current insurance, and comply with all applicable federal and state trucking regulations.

4. Our Services

Subject to a signed carrier-dispatch agreement, we may provide: load search and freight booking assistance, rate negotiation with brokers, route and appointment coordination, broker communication, and paperwork/invoicing support. You retain full and final approval over every load — Truck Peak does not book or dispatch any load without your clear approval ("no forced dispatch").

5. Fees

Your first successfully booked and dispatched load carries no dispatch fee. After that, our fee is 5% of gross booked freight for each load we book and dispatch on your behalf. "Gross booked freight" means the total carrier pay shown on the signed rate confirmation, before deductions such as fuel, tolls, factoring, driver pay, or other operating costs. Current pricing is always as shown on truckpeakdispatch.com.

6. No Guarantees

We do not guarantee the availability of loads, specific rates, or any level of revenue. Freight availability and rates vary with equipment type, lane, timing, season, broker requirements, and market conditions.

7. Carrier Responsibilities

You remain solely responsible for safety, compliance, operating authority, insurance, and the final decision to accept or decline any load. Truck Peak does not take possession of carrier freight revenue; payment flows directly from the broker or factoring company to you.

8. YouTube Portal Integration

The optional YouTube connection in the Truck Peak Portal uses YouTube API Services. By connecting a channel or using YouTube features in the portal, the portal owner agrees to be bound by the YouTube Terms of Service. The owner must have authority over the connected channel and is responsible for reviewing each video, title, description, visibility selection, and scheduled upload. YouTube may restrict visibility for uploads from API projects that have not completed its audit. The connection can be removed in the portal.

9. SMS Messaging Terms and Conditions

The Truck Peak Dispatch LLC SMS Messaging Program provides dispatch services, carrier onboarding, freight opportunities, customer support, service updates, and consented marketing communications.

Enrollment occurs when you enter your mobile number on our public carrier onboarding form and separately check the optional SMS marketing consent checkbox. Consent is not inferred from form submission and is not a condition of purchasing services. Message frequency varies and message and data rates may apply.

Reply STOP to opt out and HELP for assistance. You may also withdraw consent by emailing dispatch@truckpeakdispatch.com. Supported carriers and delivery availability may vary; we do not promise universal delivery. Messaging is provided through our messaging provider's applicable terms.

10. Limitation of Liability

To the maximum extent permitted by law, Truck Peak Dispatch LLC is not liable for indirect, incidental, or consequential damages arising from your use of our website or services, including but not limited to lost revenue, missed loads, or broker disputes.

11. Termination

Either party may terminate the dispatch relationship at any time in accordance with the terms of the signed carrier-dispatch agreement.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after a change constitutes acceptance of the revised Terms.
